Vor dem EuGH liegt unter anderem ein deutscher Fall, in dem sich Internetprovider gegen die Datenspeicherpflicht wehren. Im Januar gaben in zwei weiteren EuGH-Verfahren die Generalanwälte ihre Empfehlungen ab. In einem von Estland vorgebrachten Verfahren hatte Generalanwalt Giovanni Pitruzzella zur Verhältnismäßigkeit gemahnt und den Richtervorbehalt als Voraussetzung für den Zugriff auf Telekommunikationsdaten beschworen. … Die Bürgerrechtsorganisation Digitalcourage: ‚In Demokratien und Rechtsstaaten gibt es keine legitimen Argumente für eine anlasslose Überwachung der gesamten Bevölkerung“, schreibt die Organisation.
