Entsprechende Speicherungs- und Übermittlungsmaßnahmen müssten aber strikt auf den Anlass und seine Dauer begrenzt werden; sie müssten zudem durch ein Gericht oder eine unabhängige Institution jederzeit verbindlich überprüft werden können. Dies gelte auch für Maßnahmen gegen schwere Straftaten und bei Bedrohungen für die öffentliche Sicherheit. Generell hält der Gerichtshof fest, dass die Speicherung und Übermittlung von Verbindungsdaten immer auf den Anlass begrenzt sein müsse und nur so lange zulässig sei, solange dieser Anlass auch gegeben ist.“
